Definitions
Customer or member: Refers to the individual subscribing to an Independence Plan or purchasing services and products from Home Adapt LLC.
Independence Plans: Subscription plans offered by Home Adapt to support aging adults in maintaining their independence through fitness, wellness, home safety, and technology services.
Independent Contractor: Refers to third-party contractors hired for installation or service-related tasks.
Platform: Refers to the website, tools, and services provided by Home Adapt LLC.

Acceptance of Terms
By using our Platform, you confirm that you are at least 18 years old and have the legal capacity to enter into this Agreement.
3.
Services Provided
Home Adapt LLC provides a subscription-based service, the Independence Plans, which are designed to promote strength, safety, and independence for older adults. Our services include:
- Personalized exercise and wellness plans.
- Home safety assessments and recommendations.
- Technology check-ups and troubleshooting services.
We also act as a product reseller and connect customers with vetted independent contractors for home modifications.

Role of Home Adapt LLC: Reseller, Agent and Facilitator
Subscription Services
Home Adapt offers tiered Independence Plans tailored to different levels of support and independence. Services are delivered virtually or in person, depending on the plan tier, and availability may vary by location.
Reselling Products
We curate and resell high-quality home safety and accessibility products. Manufacturer warranties, including lifetime warranties, are provided directly by the manufacturers, and Home Adapt assists with facilitating claims if needed.
Contractor Facilitation
Home Adapt helps you connect with third-party independent contractors for installation or related services. However, contractors operate independently, and Home Adapt is not responsible for the quality or outcomes of their work.

Customer Responsibilities
Plan Eligibility
The Independence Plans are designed for proactive individuals maintaining independence and not for those requiring constant medical attention.
Responsibility for Product Selection
Customers are solely responsible for reviewing product descriptions and selecting products and packages that meet their needs. While Home Adapt LLC may provide recommendations or guidance, the final selection is the customer’s responsibility. Home Adapt LLC makes no representations or warranties regarding the accuracy, completeness, or reliability of product descriptions or other content provided on the Platform.
Contractual Relationship with Contractors
Upon scheduling an installation, Home Adapt LLC facilitates a contract between the selected independent contractor or installer and the customer. Home Adapt LLC assumes no liability for the actions, performance, or quality of work performed by independent contractors. The contractor or installer is fully responsible for their work, insurance, and liabilities.
Customer Responsibility for Permits
The customer is solely responsible for determining and acquiring any necessary permits, licenses, or approvals required by their local jurisdiction for any modifications, installations, or upgrades performed by an independent contractor. Our role is limited to facilitating the sale of products and connecting customers to independent contractors. We do not provide guidance on, or handle, permit acquisition. We recommend that customers consult their local building authorities to ensure compliance with all applicable laws and regulations before proceeding with any installation or modification.
6.
Payments and Transaction Terms
Subscription Billing
Payments for subscription plans are billed monthly. All fees must be paid in full to access plan benefits.
Refund Policy
You can cancel your plan at any time. If canceled mid-month, the fee will be prorated, and you will be refunded for the unused portion of the month. Paid plans come with a 1-month money-back guarantee for new subscribers. Please refer to our

7.
Limitation of Liability
To the fullest extent permitted by law, Home Adapt LLC disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Home Adapt LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, including the quality or safety of installation services performed by independent contractors, even if we have been advised of the possibility of such damages.
8.
Indemnification
You agree to indemnify, defend, and hold harmless Home Adapt LLC, its affiliates, and its employees from any claims, losses, damages, or expenses, including legal fees, arising from your use of our services or your violation of these Terms.
9.
Termination
We reserve the right to suspend or terminate your access to our services at any time, without notice, if you violate these Terms or engage in any conduct that we believe is harmful to our business or other customers.
10.
Changes to Terms
Home Adapt LLC reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our services after any modifications constitutes acceptance of the new Terms.
11.
Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall be resolved through good faith negotiations. If the parties are unable to resolve the dispute, it will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be held in the state where Home Adapt LLC is located, and each party will bear its own costs for legal representation.
12.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
13.
Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, and images, is the property of Home Adapt LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use of any content is prohibited without our prior written consent.
14.
Force Majeure
Home Adapt LLC will not be held responsible for any delays or failure in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, supply chain disruptions, or governmental actions.
